Terms and conditions of use

The present General Conditions of Use govern the use of the site published by the Koesio Group and accessible at koesio.com (hereinafter the Site).

By consulting the Site, the Internet user (hereinafter the User) tacitly and unreservedly accepts the present Conditions and undertakes to comply with all their provisions.

If the User does not agree with all or part of these Terms, he/she is invited not to consult the Site.

Koesio reserves the right to modify and update the content of these Terms of Use at any time. Such modifications and updates shall come into force as soon as they are published on the Site and shall be binding on the User by operation of law. For full information, the User is invited to consult the Site’s Terms of Use on a regular basis.

The Site is reserved for the private use of the User, who is prohibited from using the Site and its content for commercial purposes.

1. Accessibility

Koesio undertakes to use its best efforts to enable the User to access the Site at any time, however, and given the technical difficulties inherent in the Internet, it cannot guarantee continuous access to the Site. Koesio declines all responsibility in the event of interruption or unavailability of the Site.

In order to administer the Site, Koesio reserves the right to suspend, interrupt or limit access to all or part of the Site at any time.

2. Intellectual property

Koesio is the owner of the Site and its content, with the exception of those elements clearly identified as third parties by the designation of the rights holders in the “attribution” paragraph.

All texts, images, videos, sounds, photographs, trademarks, computer programs, presented on the Site are the intellectual property of Koesio or may be freely used by the latter either because they are free of rights, or because a license of use has been granted.

Koesio does not grant any license on the Site or its contents. The User is authorized only to represent the Site on the screen of his personal computer and to reproduce temporarily the files which constitute it in the cache memory of this computer for the sole purpose of consultation.

Any total or partial representation of this site or its content without the express prior authorization of Koesio or the designated rights holders is prohibited and constitutes an infringement punishable by articles L. 335-2 et seq. of the French Intellectual Property Code.

The same applies to any databases appearing on the website, which are protected by the provisions of the law of July 1, 1998, transposing into the Intellectual Property Code the directive of March 11, 1996, concerning the legal protection of databases, and of which Koesio or the rights holders designated in the “attribution” paragraph are the producers.

Koesio may not be held liable for any direct or indirect damage caused to the User as a result of consulting the Site, accessing or being unable to access the Site, or credit given to any information originating directly or indirectly from the Site, including damage caused to the User’s equipment when accessing the Site.

Koesio has no control over the content of third-party sites and cannot be held responsible for the integrity of, or more generally the information contained on, third-party sites accessible by Users via hypertext links set up within the framework of the Site to other resources present on the network.

Koesio cannot be held responsible for errors, lack of availability of information and/or the presence of computer viruses.

4. Law and jurisdiction

These Terms of Use are governed by French law. The applicable language is French. Any dispute arising from the application of this legal notice shall be subject to the jurisdiction of the French courts.
